1. Acceptance of Terms

By accessing or using ForgeCoach ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ForgeCoach is a skill verification platform. We provide AI-generated scenario assessments across professional skill categories. Users who pass assessments earn credentials — publicly verifiable records of assessment performance. The Service is provided for informational and educational purposes only.

3. Nature of Credentials

ForgeCoach credentials reflect performance on AI-generated scenario assessments only. They are not issued by an accredited certification body, professional licensing authority, or educational institution. Credentials have not been validated for use as employment screening tools under the Uniform Guidelines on Employee Selection Procedures (29 C.F.R. Part 1607) or equivalent regulations.

ForgeCoach makes no representation that credentials will be accepted, recognized, or valued by any employer, institution, or third party. Credential holders are solely responsible for how they represent credentials to others.

Employers and third parties who independently choose to rely on ForgeCoach credentials do so at their own risk. ForgeCoach shall not be liable for any employment, hiring, or compensation decisions made in connection with credential data.

4. Eligibility

You must be at least 18 years old to use ForgeCoach. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

5. Informational Purpose Only

IMPORTANT: ForgeCoach provides AI-generated scenario assessments for informational and educational purposes only. Assessment content reflects applied professional knowledge scenarios and should not be relied upon as authoritative guidance for any specific business, legal, financial, or technical situation.

ForgeCoach credentials reflect performance on AI-generated assessments only and do not constitute professional licensure, accreditation, or certification by any recognized credentialing body.

6. User Responsibilities

You are responsible for:

  • Providing accurate information when creating your account
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • How you represent ForgeCoach credentials to employers, clients, or third parties
  • Completing assessments honestly and without unauthorized assistance

7. Assessment Integrity

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • You will complete all assessments independently and without unauthorized assistance
  • Misrepresenting credentials earned through dishonest means is solely your responsibility
  • ForgeCoach reserves the right to revoke credentials if assessment integrity violations are discovered
  • AI-generated questions may contain errors, and ForgeCoach does not warrant the accuracy of any specific question or answer

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORGECOACH AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Reliance on credential data for hiring, compensation, or employment decisions
  • Financial loss
  • Loss of data
  • Loss of profits or revenue
  • Any damages resulting from your use of or inability to use the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE FORGECOACH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

You use this Service entirely at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • Any content or suggestions will be accurate, reliable, or effective
  • The Service will meet your requirements or expectations
  • Any errors will be corrected
  • The Service is free of viruses or harmful components

10. Indemnification

You agree to indemnify, defend, and hold harmless ForgeCoach and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any claim that your use of the Service caused damage to a third party

11. User Content

By uploading content or providing information, you grant ForgeCoach a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display this content for providing and improving the Service. You retain ownership of your content and can delete it at any time.

You represent and warrant that you own or have the necessary rights to any content you upload, and that your content does not violate any third party's rights.

12. Beta Service

ForgeCoach is currently in beta. This means:

  • Features may change, be removed, or malfunction without notice
  • Data may be lost or corrupted
  • The Service may be unavailable at times
  • We make no guarantees about the availability or functionality of any feature

By using the beta Service, you accept these additional risks.

13. Termination

We reserve the right to terminate or suspend your access to the Service at any time, for any reason, without notice. Upon termination, your right to use the Service ceases immediately.

14. Dispute Resolution

Informal Resolution: Before filing any legal claim, you agree to first contact us at hello@forgecoach.ai and attempt to resolve the dispute informally for at least 30 days.

Arbitration: Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Massachusetts, and the arbitrator's decision shall be final and binding.

Class Action Waiver: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and ForgeCoach regarding your use of the Service.

18. Governing Law

These Terms shall be governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
